1. Introduction
FlashCom is a provider of digital tools, bots, APIs, and automation resources primarily focused on Telegram services. GetMart is a FlashCom product that allows users to explore, upload, and download bots, source codes, and APIs, as well as interact with external platforms such as Bots.Business (BB), Telebot Creator (TBC), Telebot Host (TBH). This agreement governs your use of GetMart's platform and its services, including bot installations, source code downloads, and API interactions.
Welcome to FlashCom and GetMart. By accessing or using our websites, platforms, Telegram bots, APIs, or related services, you agree to comply with these Terms of Use. If you do not agree, please discontinue use immediately.
2. Use of Services
By using GetMart, you agree to comply with the following:
- GetMart allows users to install bots and source codes directly to their Bots.Business (BB) account or download the bot source code from GitHub, TBC (Telebot Creator) using various formats like JSON, YAML, or TXT or TBH (Telebot Host) using various formats like JS, Zip etc....
- Access to all features of GetMart is available once logged in using Telegram Login.
- After logging in, users can view and install bots, download source code, and test APIs through a dedicated API Info page.
- You agree not to use our services for any illegal or unauthorized purpose.
- You must not modify, adapt, or hack our services or modify another website to falsely imply that it is associated with FlashCom or GetMart.
- You agree not to transmit any worms, viruses, or any code of a destructive nature.
3. Account Registration
To access certain features of our services, you may be required to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during the registration process, including a valid email address
- Maintain and promptly update your account information to keep it accurate, current, and complete
- Maintain the security of your account by not sharing your password with others and restricting access to your account
- Notify us immediately of any unauthorized use of your account or any other breach of security
- Accept responsibility for all activities that occur under your account
- Be at least 13 years of age (or the minimum legal age in your country) to use our services
Telegram Login (OAuth Widget):
- You may log in using the official Telegram Login widget for authentication.
- When you log in with Telegram, we may receive limited profile information such as your Telegram ID, names, username, and profile photo.
- We do not store your Telegram password. Authentication is handled securely by Telegram’s systems.
- You are responsible for ensuring your Telegram account remains secure and for all activities conducted through your linked GetMart account.
Telegram Bot Login:
- You may also log in by interacting with our official Telegram Bot.
- When you log in via the bot, we collect your Telegram ID, username, display name, and profile photo. Your Telegram ID is used as the unique identifier for your GetMart account.
- Authentication for bot login is handled directly by our system using your Telegram account information.
- We never request or store your Telegram password.
- By using bot login, you authorize us to link your Telegram identity (such as your ID and public profile information) with your GetMart account.
- You are responsible for keeping your Telegram account secure. Any actions taken on GetMart using your Telegram login will be considered authorized by you.
Email Address:
- Your email is collected during account setup and verification.
- We use your email to verify your identity, secure your account, send essential updates about your bots and services, and assist with account recovery if needed.
- Your email is stored securely and is not shared or sold to third parties.
- You may request deletion of your email by contacting support, but this may limit your ability to use certain features.
We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading.
4. Bot Upload Policy
When uploading bots to GetMart, you agree to the following:
- Bots must not contain malicious code, viruses, or any form of malware.
- Bots must not engage in activities that violate user privacy or cause harm to third-party services.
- Bots uploaded to GetMart will have a price set by the uploader. The price must be paid using GetMart points (GMP), and users must ensure their balance is sufficient before purchasing or installing the bot.
- Bots must include proper credits to the original creators if based on or derived from existing work.
- Bots are available to users via GitHub or TBC download formats (JSON, YAML, TXT) depending on the platform selected.
- FlashCom is not responsible for the content of third-party bots. Bots are hosted externally via BB, TBC and TBH, and interactions with these bots are at the user's own risk.
- You retain ownership of any intellectual property rights that you hold in the bots you upload. By uploading bots, you grant FlashCom a worldwide, royalty-free license to use, host, store, reproduce, modify, and display your bots for the operation of our services.
5. Code Upload Policy
When uploading source code to GetMart, you agree to the following:
- Source code must be free of harmful, destructive, or intrusive elements, such as backdoors or exploits.
- Source code must comply with copyright and licensing regulations and include proper credits to the original creators if derived from existing work.
- Source code uploaded to GetMart can be freely viewed and downloaded by other users in formats like ZIP, RAR, or 7Z as chosen by the uploader.
- You are solely responsible for ensuring you have the necessary rights to publish and share any source code you upload.
- By uploading source code, you grant other GetMart users the right to view, download, and use your code in accordance with any licensing terms you specify.
6. API Usage
GetMart offers a dedicated API Info page where users can:
- View available API endpoints and test API calls directly within their profiles.
- Ensure that API keys, tokens, or credentials are securely stored and not shared with unauthorized parties.
- Test external APIs integrated with GetMart through a dedicated interface for real-time feedback and results.
- FlashCom is not responsible for any issues caused by third-party APIs or external services.
- API usage may be subject to rate limits to ensure service stability for all users.
- You agree not to attempt to circumvent any API limitations or restrictions.
7. Bot Installation, Code Issues, or API Malfunctions
When installing or obtaining bots, source codes, or APIs through GetMart, you agree to the following:
- FlashCom is not responsible for any issues, bugs, or violations caused by bots, codes, or APIs obtained through our platform.
- You acknowledge that bots, APIs, or source code may not always be secure, and it is your responsibility to ensure their safety before installation or use.
- If you encounter any issues with bots, APIs, or code (including security vulnerabilities, functionality problems, or violations of our Terms of Service), you must contact FlashCom immediately for assistance.
- FlashCom does not guarantee the performance, security, or compliance of third-party bots or APIs listed on GetMart.
- If you notice any harmful, unsafe, or unethical behavior in a bot, code, or API, you should stop using it and report it to FlashCom immediately.
- You understand that technical issues may occasionally result in data loss or service interruption, and FlashCom is not liable for such occurrences.
8. Admin Panel Usage
For users accessing the Admin Panel for uploading bots, codes, and interacting with external platforms like Bots.Business (BB), Telebot Creator (TBC) and Telebot Host (TBH) the following terms apply:
- Uploading Bots and Codes: Only valid file types (.json, .yaml, .txt for bots; .zip, .rar, .7z for source codes) are allowed for upload. Bots and codes must not infringe on intellectual property rights and must include appropriate credits to the original creators.
- Visibility in GetMart Store: Any bots or codes uploaded via the Admin Panel will be visible in the GetMart store, where other users can view, download, and install them.
- Bot Price: If a bot is sold, its price will be set by the uploader. The price can be paid using GetMart points (GMP), and users must ensure their balance is sufficient before purchasing or installing the bot.
- Admin Panel Responsibility: You are responsible for ensuring your content follows our platform policies, including uploading bots and codes that meet safety and security standards.
- Content Moderation: FlashCom reserves the right to review, modify, or remove any content uploaded through the Admin Panel that violates these Terms of Use.
9. Profile Updates
Users can update their personal information in their profiles, including:
- Email address
- Profile details
- Security settings (password changes, 2FA)
- GetMart points balance
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify FlashCom of any unauthorized use of your account or any other breach of security.
10. Payment and Donations
Payments or donations may be handled through third-party processors (e.g., PayPal, crypto wallets). FlashCom does not guarantee refunds unless expressly stated. Any disputes regarding payments must be taken up with the payment provider.
GetMart Points (GMP):
- GMP is the virtual currency used within the GetMart platform
- Points can be purchased through available payment methods
- Points are non-transferable and non-refundable except as required by law
- FlashCom reserves the right to modify point pricing and availability at any time
- Points have no cash value and can only be used within the GetMart ecosystem
11. Service Availability
We strive to keep services online, but we do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, upgrades, or external factors beyond our control.
FlashCom may, at its sole discretion, modify, suspend, or discontinue any aspect of the services at any time, including the availability of any feature, database, or content.
We do not guarantee that your data will always be retained. Backups are made periodically, but in the event of a system failure, data loss may occur. Users may be required to recreate accounts or re-upload data. We are not liable for any loss of data, and users are encouraged to keep personal backups of important content.
12. Limitation of Liability
To the maximum extent permitted by law, FlashCom, GetMart, and their affiliates are not liable for:
- Any indirect, incidental, or consequential damages.
- Loss of data, profits, or goodwill.
- Issues caused by third-party bots, APIs, or platforms.
- Unauthorized access resulting from your negligence or third-party breaches.
- Any content or conduct of any third party on the service.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
In no event shall FlashCom's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing our services during the twelve (12) months prior to the claim.
13. Indemnification
You agree to indemnify and hold harmless FlashCom, its staff, and affiliates from any claims, damages, or expenses arising from your use of our services, uploaded content, or violation of these Terms.
This includes, but is not limited to, any claim or demand made by any third party due to or arising out of:
- Your use of the services
- Your violation of these Terms of Use
- Your violation of any rights of another party
- Any content you submit, post, transmit, or make available through the services
14. Changes to Terms
We may revise these Terms of Use periodically. Updated terms will be posted here, and your continued use of our services constitutes acceptance of the updated terms.
We will notify you of material changes to these Terms by posting a notice on our website or sending a communication to the email address associated with your account. It is your responsibility to review these Terms periodically for changes.
15. Governing Law and Dispute Resolution
These Terms are governed by the applicable laws of FlashCom's country of operation. Any disputes should first be resolved through direct communication or mediation. If unresolved, disputes will be settled through binding arbitration, unless prohibited by local law.
You agree that any dispute arising from or relating to these Terms or your use of our services will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
16. Advertisements and Third-Party Content
Our services may display third-party advertisements. We do not control the content of these ads and are not responsible for their accuracy, legality, or safety. Interactions with advertisers are solely between you and the advertiser.
Our services may contain links to third-party websites or resources. You acknowledge and agree that FlashCom is not responsible or liable for:
- The availability or accuracy of such websites or resources
- The content, products, or services on or available from such websites or resources
Links to such websites or resources do not imply any endorsement by FlashCom of those websites or resources.
17. Intellectual Property
All content included on our services, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the services, is the property of FlashCom or its suppliers and protected by copyright and other laws.
The FlashCom and GetMart names and logos are trademarks of FlashCom and may not be copied, imitated, or used, in whole or in part, without our prior written permission.
You acknowledge that we retain all right, title, and interest in and to our services, including all intellectual property rights. Except as expressly authorized by us, you may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, or exploit any of the services.
18. Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the services will immediately cease. If you wish to terminate your account, you may simply discontinue using the services or contact us to request account deletion.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
